2. Service Requests and Authorization

By requesting services from Prendergast Towing, customers confirm that they are the vehicle owner or are otherwise legally authorized to request the service.

Customers agree to provide accurate information regarding the vehicle's location, condition, accessibility, and any known mechanical or safety issues.

Authorization to perform services may be provided verbally, electronically, or in writing, where permitted by applicable law.

Customers are responsible for ensuring that the vehicle can legally be accessed, transported, or released.

3. Pricing, Estimates, and Payment

Service pricing may vary based on several factors, including:

  • Distance traveled and towing destination
  • Vehicle size, weight, and condition
  • Equipment and labor requirements
  • Recovery complexity and accessibility
  • Time of service and emergency conditions
  • Additional services requested or required

Any estimate provided before service is based on the information available at that time.

Additional charges may apply if previously undisclosed conditions require additional labor, equipment, or transportation, subject to applicable laws and required customer authorizations.

Payment terms and accepted payment methods will be communicated when services are arranged.

Customers are responsible for authorized service charges unless other payment arrangements have been confirmed.

4. Vehicle Towing and Transportation

Prendergast Towing takes reasonable precautions to transport vehicles safely and professionally.

Customers should remove valuables, personal belongings, and unsecured items before transportation whenever safely possible.

Prendergast Towing is not responsible for pre-existing vehicle damage, mechanical defects, or failures unrelated to the company's negligence or misconduct.

Certain vehicles, including lowered vehicles, modified vehicles, electric vehicles, and vehicles involved in accidents, may require specialized handling.

Customers must disclose known vehicle modifications, mechanical problems, or conditions that could affect safe loading, transportation, or unloading.

Nothing in these Terms excludes liability that cannot legally be limited under applicable law.

5. Roadside Assistance and Battery Services

Roadside assistance services are intended to help customers address common vehicle emergencies.

Battery testing, jump-starts, and battery replacement services do not guarantee that a vehicle will start or continue operating if additional mechanical or electrical issues exist.

Prendergast Towing is an authorized Interstate Battery dealer. Applicable battery warranties are subject to the specific manufacturer's warranty terms and conditions.

Customers acknowledge that roadside assistance may identify additional vehicle problems requiring service by a qualified automotive repair facility.

6. Vehicle Recovery and Winch-Out Services

Vehicle recovery may involve challenging conditions, including uneven terrain, mud, sand, ditches, accident scenes, and other hazardous environments.

Customers acknowledge that recovery operations may involve inherent risks, particularly when a vehicle is already damaged, disabled, or positioned in an unstable location.

Prendergast Towing will use reasonable care and professional judgment when performing recovery services.

Additional equipment, labor, or recovery procedures may be necessary depending on site conditions.

The company reserves the right to suspend recovery operations when conditions become unsafe.

7. Scheduling, Arrival Times, and Delays

Prendergast Towing strives to provide prompt and reliable service.

However, estimated arrival and completion times are not guaranteed.

Delays may result from traffic, weather, road closures, emergency calls, equipment availability, or other circumstances outside our reasonable control.

Customers will be informed of significant delays when reasonably possible.

8. Cancellations and Service Fees

Prendergast Towing understands that circumstances can change and customers may need to cancel a scheduled towing, transportation, recovery, or roadside assistance service.

A cancellation fee of up to 50% of the quoted service price may apply, depending on the circumstances, including whether a driver has been dispatched, the distance traveled, equipment preparation, labor commitments, or other costs associated with the service request.

Cancellation fees are subject to applicable law and must be disclosed to the customer as required before they become enforceable.

Customers are encouraged to notify Prendergast Towing as soon as possible when a cancellation is necessary.

For additional information about cancellation fees and applicable charges, please call (520) 723-8697.

Prendergast Towing provides vehicle towing and storage services associated with police departments and authorized law enforcement requests.

Vehicles may be transported and stored following accidents, law enforcement directives, impoundments, or other legally authorized circumstances.

Towing and storage fees, required documentation, vehicle access, release eligibility, and release procedures are subject to applicable Arizona laws and the requirements of the responsible law enforcement agency.

Certain vehicles may be subject to legal holds or additional authorization requirements before release.

Vehicle owners or authorized representatives may be required to provide identification, proof of ownership or authorization, and applicable documentation before a vehicle can be released.

An itemized statement of applicable towing and storage charges will be provided in accordance with Arizona law.

For information regarding police-authorized vehicle storage, storage fees, vehicle release requirements, or related questions, please contact Prendergast Towing at (520) 723-8697.

Prendergast Towing maintains insurance coverage appropriate to its business operations, subject to applicable policy terms and limitations.

The company is not responsible for damage caused solely by pre-existing defects, unrelated mechanical failures, or circumstances beyond its reasonable control.
